Posting of employees in Europe
Workers’ mobility is essential to the globalized economy, not only for the production and exporting of goods, but also for supplying services related to installation and commissioning as well as service and maintenance.
In recent years, European countries have introduced comprehensive reporting requirements for posting of employees for non-resident companies. These reporting requirements mainly serve the prevention of social dumping in the individual countries. However, the correct observance of these requirements poses special challenges for companies.
Which reporting obligations must be observed? The VDMA information documents in German and English provide a practical overview of the regulations in the individual European countries. This information is supplemented by notes on freedom of services and data protection when posting an employee, as well as the cooperation agreement with Inhouse Mobility GmbH.
VDMA considers that the Implementing Directive 2014/67/EU is being applied excessively in some member states. Reporting obligations for non-domiciled companies that differ from member state to member state are increasingly impeding the ability to plan reliably and flexibly organise employee postings. Therefore the VDMA demands uniform reporting requirements in the EU member states and posting should not require reporting within the first 10 working days.
